SHUSH – Vow of Silence Album Release Promotion

These Terms and Conditions apply to the SHUSH Vow of Silence Album Release Highest-Spender Promotion (the "Promotion"). By placing a Qualifying Order during the Promotion Period, you agree to be bound by these Terms and Conditions.

1. Promoter

The Promotion is administered through the official SHUSH merchandise store at www.shushmusic.com.

2. Promotion Period

The Promotion opens at 19:00 BST on 21 August 2026 and closes at 23:59 BST on 4 September 2026 (the "Promotion Period").

Orders placed before the Promotion opens or after the Promotion closes will not qualify.

The time at which an order is successfully recorded by the SHUSH merchandise store will determine whether the order was placed within the Promotion Period.

3. Eligibility

The Promotion is open to customers aged 18 years or over who are legally permitted to participate in this type of promotion in their country, state, province or territory of residence and whose delivery destination is supported by the SHUSH merchandise store.

Employees, contractors or agents of the Promoter who are directly involved in administering the Promotion, and members of their immediate households, are not eligible to win.

Participation is void where prohibited or restricted by applicable law. It is the participant's responsibility to ensure that participation is lawful in their place of residence.

4. How to Participate

To participate, an eligible customer must place and successfully pay for an order through the official SHUSH merchandise store at shushmusic.com during the Promotion Period.

No separate entry form, promotional code or registration is required.

Each eligible order placed during the Promotion Period will be treated as a separate Qualifying Order.

5. What Counts as a Qualifying Order

For the purposes of determining the winners, the value of a Qualifying Order is the amount actually paid for eligible merchandise after any discounts have been applied, but excluding:

• shipping and delivery charges;
• taxes, VAT, duties or customs charges where separately identified;
• gift cards or store credit purchased;
• the value of gift cards or store credit redeemed;
• tips, donations or other non-merchandise payments;
• refunded, returned or cancelled products; and
• any other amount which the Promoter reasonably determines does not represent a genuine purchase of SHUSH merchandise.

The resulting amount is referred to in these Terms as the "Qualifying Order Value".

6. Single Orders – Purchases Are Not Combined

The Promotion is based on the value of an individual order.

Multiple separate orders placed by the same customer will not be added together for the purpose of determining the highest spender.

For example, two separate qualifying orders worth £100 each will not be treated as one £200 order.

7. Orders in Different Currencies

Where an order is placed in a currency other than GBP, the Promoter will convert the Qualifying Order Value into pounds sterling (GBP) solely for the purpose of ranking qualifying orders.

The conversion will use the GBP order value recorded by the SHUSH store or payment platform where available. If this is unavailable, the Promoter will use a recognised exchange rate applicable on the date the relevant order was placed.

The Promoter's calculation of the converted GBP value will be final except in the case of manifest error.

8. First Prize – Highest Qualifying Order

The eligible customer responsible for the single Qualifying Order with the highest Qualifying Order Value during the Promotion Period will receive:

One (1) Acrania – The Beginning of the End Wax Mage vinyl pressing, released by Silverback Gorilla Records and from the Wax Mage Pressing Edition limited to 25 copies worldwide.

The exact individual Wax Mage colour/pour and individually numbered sleeve awarded will be selected by the Promoter from the Promoter's available copies.

Because Wax Mage records are individually produced, the appearance of the prize may differ from photographs used to advertise the Promotion.

The vinyl will be supplied in the condition described in the promotional materials and/or winner notification. Minor manufacturing variations inherent to individually produced vinyl records are not defects.

There is no cash alternative to the First Prize and the winner may not request a different Wax Mage copy, unless the Promoter agrees otherwise at its sole discretion.

The prize is personal to the winner and may not be exchanged through the SHUSH store for merchandise, cash or store credit.

9. Runner-Up Prize – Second-Highest Qualifying Order

The eligible customer responsible for the single Qualifying Order with the second-highest Qualifying Order Value during the Promotion Period will receive a refund equal to:

50% of their Qualifying Order Value, up to a maximum refund of £200 GBP.

For example:

• A £100 Qualifying Order would receive a £50 refund.
• A £250 Qualifying Order would receive a £125 refund.
• A £400 Qualifying Order would receive a £200 refund.
• A £600 Qualifying Order would still receive a maximum refund of £200.

Shipping charges, taxes, duties and other excluded amounts will not be included when calculating the 50% refund.

The Runner-Up Prize will normally be returned to the original payment method used for the qualifying purchase.

Where refunding the original payment method is not reasonably possible, the Promoter may arrange an equivalent payment or store credit with the winner's agreement.

10. Determining the Winners

This is not a random prize draw.

The First Prize will be awarded to the eligible customer who places the single Qualifying Order with the highest Qualifying Order Value during the Promotion Period.

The Runner-Up Prize will be awarded to the eligible customer who places the single Qualifying Order with the second-highest Qualifying Order Value during the Promotion Period.

Winners will be determined using the Promoter's Shopify/store order records and payment records after the Promotion has closed and the validity of the relevant orders has been verified.

11. Tie-Breaking

If two or more Qualifying Orders have exactly the same Qualifying Order Value, the order which was successfully completed first according to the SHUSH store's recorded order timestamp will rank higher.

The same tie-breaking process will apply when determining the Runner-Up.

12. Returns, Refunds and Cancellations

An order must remain a genuine qualifying purchase in order to remain eligible for a prize.

If all or part of an order is cancelled, returned, refunded, charged back or otherwise reversed before the winners are finalised, the Qualifying Order Value will be recalculated using only the merchandise value that remains valid.

If this causes an order to fall below another qualifying order, the rankings will be adjusted accordingly.

Statutory consumer rights are not affected. Nothing in these Terms is intended to prevent a customer exercising any cancellation, return, refund or other consumer right available under applicable law.

However, exercising such rights may reduce the Qualifying Order Value and therefore affect eligibility for a prize.

13. Returns After a Prize Has Been Awarded

Nothing in these Terms removes or restricts any statutory right to return eligible merchandise.

However, if a winner subsequently returns or obtains a refund for merchandise forming part of the winning Qualifying Order and that refund would have caused the order not to rank first or second had it occurred before winners were determined, the Promoter reserves the right, where permitted by law, to withdraw or recover the promotional prize or its reasonable equivalent value.

This clause will not apply where a return or refund arises because goods were faulty, damaged, incorrectly supplied, or where applying the clause would conflict with the customer's statutory rights.

14. Genuine Purchases Only

Orders must be genuine purchases made for legitimate personal use or gifting.

The Promoter may disqualify an order where it reasonably believes that there has been:

• fraud;
• payment fraud or unauthorised use of a payment method;
• deliberate manipulation of the Promotion;
• automated or bot-assisted purchasing;
• collusion designed to manipulate the results;
• reseller activity undertaken primarily to manipulate the Promotion;
• an artificial or sham transaction;
• a deliberate attempt to circumvent these Terms; or
• other conduct that materially undermines the fair operation of the Promotion.

A customer will not be disqualified merely because they place a legitimately high-value order.

15. Stock Availability

All merchandise remains subject to normal SHUSH store availability.

Customers should not place orders for products they do not genuinely wish to purchase solely for the purpose of temporarily increasing their Qualifying Order Value.

The Promotion does not guarantee that any particular product, size, design or item will remain available throughout the Promotion Period.

16. Winner Verification

Before awarding a prize, the Promoter may reasonably request information required to verify:

• the winner's identity;
• age;
• country of residence;
• ownership or authorised use of the relevant order or payment method;
• delivery details; and
• compliance with these Terms.

A participant who cannot reasonably demonstrate eligibility may be disqualified.

17. Winner Notification

The First Prize winner and Runner-Up will be contacted using the email address supplied with their order within 7 days of the Promotion closing, subject to order verification.

Winners must respond within 14 days of the Promoter's first winner-notification email.

If a winner cannot be contacted, does not respond within the stated period, declines the prize, is found to be ineligible, or is disqualified in accordance with these Terms, the Promoter may award the relevant prize to the customer with the next-highest eligible Qualifying Order Value.

18. Delivery of the First Prize

The Promoter will arrange reasonable standard shipping of the Acrania Wax Mage vinyl to the First Prize winner at the Promoter's expense.

The winner is responsible for providing a complete and accurate delivery address.

Where international delivery creates customs charges, import VAT, duties, brokerage fees or other governmental charges, responsibility for those charges will be determined by applicable law and the shipping terms communicated to the winner.

The Promoter will package the vinyl with reasonable care appropriate to a collectible vinyl record.

19. Payment of the Runner-Up Prize

The Runner-Up refund will be processed as soon as reasonably practical following winner verification and normally within 14 days of confirmation.

Banks and payment providers may require additional time before a refund appears in the recipient's account.

20. Prize Substitution

The Promoter intends to award the prizes exactly as described.

If circumstances outside the Promoter's reasonable control make it impossible to supply the advertised First Prize, the Promoter will, where required by applicable law, provide a reasonable equivalent prize of comparable nature and value.

The Promoter will not substitute a lower-value prize simply because the Promotion receives more participation than expected.

21. No Guarantee Regarding Resale Value

Any description of the Acrania Wax Mage vinyl as rare, collectible or limited refers to the nature of the pressing and not to a guaranteed financial or resale value.

The Promoter makes no representation or guarantee regarding the current or future resale value of the prize.

22. Publicity and Winner Information

The Promoter may announce limited information about the results of the Promotion where legally required or reasonably necessary to demonstrate that valid prizes were awarded.

The Promoter will not publish a winner's full postal address, payment information or other unnecessary personal information.

Any request for a winner to participate in additional promotional photographs, videos, interviews or social media content will be subject to the winner's consent where required by law.

23. Personal Data

Personal information supplied in connection with the Promotion will be processed for purposes including:

• administering the Promotion;
• verifying qualifying orders;
• contacting winners;
• delivering prizes;
• preventing fraud and abuse; and
• complying with applicable legal and regulatory obligations.

Personal data will otherwise be handled in accordance with the SHUSH Privacy Policy available on the SHUSH website.

24. Fair Administration

The Promoter will administer the Promotion fairly and in accordance with these published Terms.

The Promoter's decision regarding calculations, eligibility and ranking will be final where reasonably made in accordance with these Terms, except where applicable law provides otherwise.

Records of qualifying order values and the determination of the winners will be retained for a reasonable period after the Promotion ends.

25. Technical Problems

The Promoter is not responsible for orders that are not successfully completed because of circumstances beyond its reasonable control, including internet failure, payment-provider failure or technical interruption.

An order is considered entered only once it has been successfully submitted, accepted by the store and payment has been authorised or otherwise successfully processed.

26. Changes, Suspension or Cancellation

The Promoter will not materially alter these Terms after the Promotion has begun where doing so would unfairly disadvantage participants.

If circumstances outside the Promoter's reasonable control make it necessary to suspend, cancel or materially alter the Promotion, the Promoter will take reasonable steps to minimise disappointment and communicate any necessary change clearly.

Nothing in this clause permits the Promoter to withhold an advertised prize merely because participation, sales or commercial performance differ from expectations.

27. Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any statutory consumer right that cannot legally be excluded.

Subject to the above, the Promoter will not be responsible for losses arising from circumstances outside its reasonable control.

28. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be treated as modified or removed only to the extent necessary, and the remaining provisions will continue to apply.

29. Governing Law

These Terms and the Promotion are governed by the laws of England and Wales, without depriving consumers of any mandatory protections available to them under the laws of their country of residence.

The courts of England and Wales will have jurisdiction, subject to any mandatory rights a consumer may have to bring proceedings in the courts of their place of residence.
